Overview & Acceptance

These Terms of Service (the “Terms”) govern your access to and use of ChimneySafe Canada’s website, scheduling platform, and services (“Services”). By accessing or using the Services, you agree to be bound by these Terms and any policies referenced herein, including our Privacy Notice. If you are using the Services on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

Services are offered only in Canada and priced in Canadian dollars (CAD). Certain provisions may vary based on provincial or territorial consumer protection statutes as outlined below.

Bookings & Payments

Prices are in CAD. Taxes are calculated by province or territory. Unless otherwise stated in a written estimate, payment is due upon completion of the booked service. For multi-visit projects, progress invoices may be issued.

Cancellations

Please provide at least 24 hours’ notice to avoid a cancellation fee. If we arrive at the service address and cannot gain access, a no‑show fee may apply.

Warranties

We warrant that our workmanship will be performed in a professional and workmanlike manner consistent with industry standards. Parts and materials are covered by the manufacturer’s warranty where applicable.

Limitations

ChimneySafe is not liable for pre-existing conditions, hidden defects, or code violations discovered during service. We may halt work if unsafe conditions are identified. You are responsible for ensuring clear access to work areas and for securing pets and valuables.

To the maximum extent permitted by Canadian law, our aggregate liability for any claim is limited to the amount paid for the specific service giving rise to the claim. This limitation does not apply to losses that cannot be limited under applicable law, including for Quebec consumers where prohibited.

Acceptable Use

You agree not to misuse the site, scheduling tools, or communication features, including by attempting to disrupt or gain unauthorized access to systems, scraping content, or interfering with other users’ access.

Privacy & Data

We collect and use personal information to provide Services, process bookings and payments, and improve safety and quality. Data is stored in Canada or in jurisdictions offering comparable protections, subject to contractual safeguards. You may request access or correction as permitted by law.

Province/Territory Notices

Dispute Resolution & Governing Law

These Terms are governed by the laws of the province or territory where the service is performed and the federal laws of Canada applicable therein. Except where prohibited by consumer protection laws (including in Quebec), disputes will first be addressed through good‑faith negotiations and, if unresolved within 30 days, may be submitted to mediation and then to binding arbitration seated in the same province or territory, under the rules of a recognized Canadian arbitration body. Each party will bear its own costs unless the arbitrator decides otherwise.

Changes to Terms

We may update these Terms to reflect changes in laws, Services, or business practices. Material changes will be indicated by an updated effective date and an in-page notice. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
